Abstract
This SHRM presentation clarifies the definitions of executive actions and then guides the HR community in navigating these new orders. Overview of Presidential Executive Actions • Executive Orders (EO) – Primarily Aimed At Federal Agencies and Officials o Instructs agencies in implementing policies, managing resources or enforcing laws o Have the force of law if the topic of the EO is “founded on the authority of the President derived from the Constitution or statute.” • Executive Memoranda -- Directs Federal Policy Through Federal Agencies o Less Formal, often used for administrative purposes o Not required by law to be printed in the Federal Register; not required to cite the President’s legal authority • Proclamations – Often Used for Ceremonial or Symbolic Purposes o Many do not have the force of law (unless the President is given the authority over private individuals by the Constitution or a federal statute)
